Process: Payroll release rules by DOLE, cut off and permissible delays.

To clarify issues on payroll, please refer to this for adjudication.   And to stop conflicts:






For clarity of every one:

1.   Cut offs  of even as 15 days is allowed in certain private firms;
2.   There is a maximum time limit of 5 days from cut off to allow the credit/withdrawal of salaries.  

Please read and lets give allowance for bank errors and employee missteps  and ours.    We should not fret much for salary delays which is becoming more frequent, because delay of five days is permissible and Labor Code says twice a month payment of salaries.  

Lets give ourselves some relief and freedom from diseases due to stress due to our concern for employee welfare.  





Payroll Release Delay Rules and Funding Cut-Off Periods

Philippine Legal Framework & Practical Guidance (2025 Edition)

1. Overview

“Payroll release” is the moment wages are actually made available to the employee (cash on hand, credited to their bank or e-wallet, or paid through any valid modality). “Funding cut-off” is the internal deadline by which the employer must have cleared and funded payroll with its bank or cash office so that release can happen on time.

While the cut-off is largely an operational concept, Philippine labour statutes, regulations, and jurisprudence dictate non-negotiable outer limits on when employees must be paid and what happens when delays occur.

3. Standard Payroll Timing Rules

  1. Cut-Off Periods (Operational) Typical private-sector pattern:

    • 1 – 15 of the month → Credit on 30ᵗʰ or 31ˢᵗ
    • 16 – 30/31 → Credit on 15ᵗʰ of the succeeding month

    This meets the Labor Code’s “twice-a-month / ≤ 16-day gap” requirement only if the employer guarantees that the crediting date is ≤ 16 days after the end of each cut-off (e.g., 15 days after the 1 – 15 cut-off). Longer lags violate Art. 102 even if employees “agree.”

  2. Five-Day Processing Rule (DOLE Practice Note) DOLE inspectors commonly treat five (5) working days after the close of a cut-off as the outer limit for processing and funding, citing equity and Art. 1701 (Civil Code).

  3. Holiday & Rest-Day Pay Holiday/rest-day differentials accrued within a cut-off should be paid together with the regular wages for that period unless CBA sets a shorter interval.

  4. Commissions & Variable Pay Must be released not later than the succeeding regular payday after the amount becomes ascertainable (DOLE Handbook of Workers’ Statutory Monetary Benefits, 2024 ed.).


4. Permissible Delays & Force Majeure

    • InstaPay: real-time 24/7 but subject to ₱50 K/transaction cap and per-transaction fee. Employers must initiate transfers early enough to respect these windows, especially on a Friday where a miss pushes crediting to Monday (risking Art. 102 breach).

I'd like to provide some clarifications regarding payroll processes and payment schedules.

We have a few options to consider for the daily payroll of Morong GTs:
* **Option 1: Pay without a cut-off.** This would mean that payroll processing would extend until 6-7 PM every pay day  

  * **Option 2: Implement a Thursday cut-off.** This would reduce the 6-day cycle by two days of data storage, which might lead to objections.

*  **Option 3: Implement a Friday cut-off.** This would only exclude Saturday from the payroll cycle.
*   **Option 4: Pay on Monday.** This option would not involve any withheld payments from the previous week.

Reality:  1.  Tractors at Pangasinan were found out to be unlubricated since acquisition OR 3 YEARS AGO SINCE                        ITS ACQUISITION
              2.  The oil of the tractor is dark black, sooty is sludge like alll ready, and is inviting major engine seizure or                        catastrophy>
             3.  The tractor cost us P200,000 on the average, and which is not cheap, especially if you add cost of                               freight in Iloilo and Calapan
             4.  The tractor is a workhorse of the interment operation and maintenance.  Why is this not being attended                      to?
             5.  The GT of Pangasinan allege that they made the request for lubricating oil and nothing has happened:                       either at SBU's desk or at Grove????!
             6.  Reactive vs preventive maintenance:

                Reactive:    repair pag nasira na.

                Preventive:   Do the necessary things in anticipation of a breakdown involving
                                     machine operations prior to breakdown, calculating the                                                                                                 estimated   life span:of equipment

                Oil -  loss of viscosity every 5,000 km or 3 mos whichever comes first
                Fan belt -   yearly
                Oil filter -   every oil change
                Fuel filter-   every six months
                Air cleaner   every change oil for cleaning, every year change/replace


What to do no next, action plan:

1.   Have the tractors at Panga and  HAMP oil changed.    Facilitate PO, purchase and oil change itself

    1.  Demand accountability,, NTE from the boss and GT in charge

2.  Establish a TPM culture and system

    1.  Enroll the GT in charge in an ownership of the procedure:   via the MR.   MR
         for new equipment.   So with the CMO and Accounting at Grove

    2.  Communication education and training -  CIRCULATE THIS MEMO AND OTHER
         TPM lubrication procedures

    3.  Post TPM  schedule at warehouse or parking site of tractors

    4.  Laminate the TPM schedules (there would be three:  daily quarterly and annual

    5.  JUS is in charge of this system and would call up quarterly or annually

   6.   Make this an important priority in your work, if it comes across your desk

What to look for when buying a used excavator: from Diesel Creek Matt

1.  Watch for the pivot and there are many at the excavator arm, look for them if they are loose;'
2.   Look for the grease points if they have been greased regularly
3.   Look well at the turntable bearing.   It could be expensive to replace.
4.   Look at the undercarriage:

      2.  Undercarriage bearing -  are they moving well or stuck
      3.  Track pads:   are they still thick or thin and are bent?  Loose pads
